Pocket Girl disclaims all responsibility for emotional attachment, emotional interpretation, or psychological impact that may result from using the service. The user is fully responsible for their use and understanding of the artificial nature of the AIs.
6. User Commitments
Respectful Use: The user agrees to behave respectfully and not disrupt the proper functioning of the service.
Penalties: In case of inappropriate behavior or violation of the Terms of Use, the site reserves the right to suspend or delete the user's account without refunding any tokens.
7. Intellectual Property

4.2 Token System

Validity: Tokens are valid for an unlimited duration unless otherwise indicated. In case of subscription cancellation, unused tokens are deactivated but automatically reactivated upon resubscription.
Usage: Tokens allow access to exclusive video content and advanced interactions with artificial intelligences.
Additional Purchase: It is possible to purchase additional tokens according to current rates displayed on the site.
Article 5 - Pricing and Payment Terms
5.1 Subscription Rates
Subscription rates are as follows:

Additional token rates are displayed in real-time on the purchase page and may be modified at any time.
5.2 Payment Terms

Billing: Payment is made by automatic deduction according to the chosen frequency (monthly, quarterly, or annually).
Automatic renewal: The subscription automatically renews for the same duration, unless cancelled by the User.
No fraudulent transactions: No fraudulent transactions will be tolerated on your bank statement.
Article 6 - Subscription Refund Policy
6.1 General Principle
Subscriptions purchased on our platform provide access to a token system allowing consultation of exclusive and personalized content. Due to the digital and consumable nature of these services, strict conditions apply to refund requests.
6.2 Refund Conditions
6.2.1 Consumption Threshold
Refund of a subscription is only possible if the subscriber has consumed fewer than 20 tokens at the time of their request. Beyond this threshold, the subscription is considered substantially used and cannot be refunded, even partially.
6.2.2 Consumption Calculation
Token consumption is calculated cumulatively from the beginning of the subscription period. Each access to exclusive content results in automatic and irreversible deduction of the corresponding number of tokens.
6.3 Exceptions to Right of Withdrawal
In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium whose performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal.
By subscribing and using even a single token, the subscriber:
- Gives express agreement for immediate commencement of service execution
- Expressly waives their right of withdrawal for the part of the service already provided
- Acknowledges the consumable and non-storable nature of the digital content provided
6.4 Definitive Nature of Consumption
6.4.1 Operational Costs
Each token use generates real technical and operational costs for our company (infrastructure, licenses, data processing). These costs are irreversibly incurred upon content access.

Article 7 - Non-Refundable Tokens
Absolute Principle: Purchase of additional tokens is final and non-refundable in all cases, without exception.
Immediate Consumption: Tokens consumed for actions (notably videos or interactions) are not refundable, even in case of disconnection or technical problems not attributable to the site.
Rate Modifications: The site reserves the right to modify rates, token usage, and available actions, without prior notice.
Article 8 - Termination and Suspension
8.1 Termination by User
Procedures: To cancel their subscription, the User must go to their personal account and click "unsubscribe".
Effective Date: Cancellation takes effect at the end of the current subscription period. The User continues to benefit from the service until this date.
Unused Tokens: Unused tokens at the end of the subscription are deactivated but preserved. They are automatically reactivated upon future resubscription.
8.2 Termination by Company
The Company reserves the right to suspend or terminate service access in case of:
- Non-compliance with these T&C
- Fraudulent use of the service
- Inappropriate or illegal behavior
- Non-payment or payment incident
Article 9 - Service Availability
Availability Commitment: The Company commits to maintaining service availability 99% of the time.
Maintenance: Scheduled interruptions may occur for maintenance. Users will be informed whenever possible.
Technical Incidents: In case of outages attributable to the Company preventing normal token usage, these may be re-credited upon justified request.
Article 10 - Obligations and Responsibilities
10.1 User Obligations
The User commits to:
- Be of legal age and have legal capacity to contract
- Provide accurate information during registration
- Use the service in accordance with its intended purpose
- Not attempt to circumvent security systems
- Respect intellectual property rights
10.2 Liability Limitations
The Company's liability is limited to the amount of sums actually received from the User during the 12 months preceding the event causing the damage.
The Company cannot be held responsible for indirect damages, lost profits, data loss, or moral prejudice.
Article 11 - Intellectual Property

Article 14 - Miscellaneous Provisions
14.1 Partial Nullity
If one or more stipulations of these T&C are held invalid or declared as such by a court decision, the other stipulations shall retain their full force and scope.
14.2 Non-Waiver
The Company's failure to enforce at any given time any of these conditions cannot be interpreted as waiving the right to subsequently enforce these same conditions.
